Most of the articles out there speak about how these brokerages affect the end user but many new to the market which would like to open their own companies want to find the correct answers which sometimes you are learning the hard way. In an extremely liquid market, with over $5tn traded daily, there is a reason to open a brokerage. One particularly common initial question in the forex industry is that of unregulated/ regulated and/or offshore entity.

To be unregulated forex broker does not necessarily make you a scam though the odds of been considered are against you. There are many scams in the forex world, which means dealing with an unregulated broker can be like playing with fire for traders. In the case of fraud, traders have little, if any, recourse.

Limitations of regulation:

  • Expected to follow strict rules to continue operating legally.
  • Regulations can be costly and overbearing
  • If break the rules and does wrong by their clients, they are subjected to various penalties. 
  • Need to inform client of all the conditions as to make an informed investment
  • Need to go through regular audits.
  • Regulated brokers tend to pass the start-up and operational costs down to the client.

Benefits of unregulated:

  • Cheaper as not minimum capital is required
  • Can offer bonuses to bring clients in
  • Offer higher leverage that can increase earnings
  • No need to cover losses and clients can loose more than the initial capital
  • Price differentials can change overnight without informing
  • Can move their own currency prices so that the loss limit is reached
  • Offer traders more freedom and flexibility in their trading than their regulated counterparts.
  • Offshore can avoid taxation. Locations with lower offshore taxation can be heavens for those entities
  • No need to worry about compliance
  • lower start-up and operational costs involved.

Limitations

  • Not so easy to advertise
  • Regulated bodies will chaise you away
  • Not easy to get bank accounts
  • Not easy to get Psps
  • High costing call centres
  • Higher cost in terms of LPs
  • Review websites will categorise you as scam
  • Higher cost in advertising in related websites i.e. wikifx
  • No awards can be won
  • No opportunity to join big FX Expos
